Opće odredbe DASP (Dynamic Adaptive Solar Platform) predstavlja softversku platformu namijenjenu podršci pri planiranju, projektovanju, analizi, dokumentovanju i upravljanju fotonaponskim i energetskim projektima. Kreiranjem korisničkog računa, pristupom platformi ili korištenjem bilo koje njene funkcionalnosti, korisnik potvrđuje da je pročitao, razumio i prihvatio ove Uslove korištenja. 2. Zaštita podataka i povjerljivost DASP poštuje privatnost svojih korisnika i obavezuje se da će lične podatke obrađivati u skladu sa važećim propisima o zaštiti podataka. Korisnički podaci neće biti prodavani, ustupani niti namjerno dijeljeni trećim stranama bez zakonskog osnova ili saglasnosti korisnika. DASP primjenjuje odgovarajuće tehničke i organizacione mjere zaštite podataka, pri čemu korisnik prihvata da nijedan online sistem ne može garantovati apsolutnu sigurnost. 3. Dostupnost platforme DASP se pruža kao online usluga te, iako se ulažu razumni napori kako bi platforma bila stabilna i dostupna, ne može se garantovati njen neprekidan rad. Povremeno mogu nastati softverske greške, problemi u komunikaciji, ograničenja performansi ili druge tehničke poteškoće. Uočeni nedostaci će biti otklonjeni u razumnom roku kada god je to moguće. 4. Održavanje, nadogradnje i prekidi rada Radi unapređenja sigurnosti, stabilnosti i funkcionalnosti sistema, DASP može povremeno biti podvrgnut održavanju, nadogradnjama, izmjenama ili popravkama. Tokom takvih aktivnosti pojedine funkcije ili kompletna platforma mogu privremeno biti nedostupne. Kada je to razumno moguće, korisnici će biti obaviješteni putem obavještenja unutar same platforme. 5. Podaci i usluge trećih strana Određene funkcionalnosti platforme mogu koristiti podatke, baze podataka, tehničke specifikacije proizvođača, kartografske servise, meteorološke servise, API-je ili druge izvore trećih strana. DASP nema kontrolu nad tačnošću, potpunošću ili dostupnošću takvih izvora te ne može preuzeti odgovornost za eventualne greške, netačnosti, propuste ili prekide rada koji potiču od trećih strana. 6. Priroda generisanih rezultata Platforma može generisati proračune, simulacije, preporuke, izvještaje, konfiguracije, alokacije stringova, odabire opreme, procjene proizvodnje energije i druge rezultate. Takvi rezultati služe isključivo kao pomoć pri planiranju i donošenju odluka te ne predstavljaju zvanični projekat, stručni elaborat, tehničko odobrenje niti potvrdu usklađenosti sa propisima. Prije bilo kakve implementacije svi rezultati moraju biti provjereni od strane kvalifikovane stručne osobe. 7. Stručna odgovornost Fotonaponski sistemi, baterijski sistemi i elektroinstalacije predstavljaju tehnički složene i sigurnosno osjetljive sisteme. Korisnik prihvata da odgovornost za projektovanje, instalaciju, konfiguraciju, puštanje u rad, održavanje i siguran rad sistema snosi isključivo osoba ili organizacija koja izvodi navedene radove. Platforma ne zamjenjuje stručno znanje, profesionalnu procjenu, tehničku dokumentaciju proizvođača niti zakonske i tehničke propise. 8. Ograničenje odgovornosti U najvećoj mjeri dopuštenoj važećim zakonima, DASP ne odgovara za bilo kakvu direktnu ili indirektnu štetu nastalu korištenjem platforme, oslanjanjem na generisane rezultate ili implementacijom preporuka koje platforma pruža. Ovo uključuje, ali nije ograničeno na, oštećenje invertera, baterija, električne opreme, gubitak proizvodnje, gubitak podataka, finansijske gubitke, prekide poslovanja, materijalnu štetu ili povrede osoba. Odgovornost za sigurno i propisno izvođenje svih radova ostaje isključivo na stručnim licima uključenim u realizaciju projekta. 9. Isključenje garancije Platforma se pruža po principu „kakva jeste“ i „kako je dostupna“. DASP ne garantuje neprekidan rad sistema, potpunu odsutnost grešaka niti prikladnost generisanih rezultata za određeni projekat ili namjenu. 10. Izmjene platforme DASP zadržava pravo da u bilo kojem trenutku izmijeni, unaprijedi, ograniči ili ukine pojedine funkcionalnosti platforme ukoliko je to potrebno iz tehničkih, operativnih ili sigurnosnih razloga. 11. Prihvatanje uslova Korištenjem platforme korisnik potvrđuje da prihvata ove Uslove korištenja i razumije da konačna odgovornost za sve tehničke odluke i realizaciju projekata ostaje na korisniku i stručnim osobama uključenim u projekat.

Datenschutz und Vertraulichkeit DASP respektiert die Privatsphäre seiner Nutzer und verarbeitet personenbezogene Daten gemäß den geltenden Datenschutzbestimmungen. Benutzerdaten werden weder verkauft noch ohne rechtliche Grundlage oder Zustimmung des Nutzers an Dritte weitergegeben. DASP setzt angemessene technische und organisatorische Maßnahmen zum Schutz der gespeicherten Daten ein. Dennoch kann keine Online-Dienstleistung absolute Sicherheit gewährleisten. 3. Während solcher Maßnahmen können einzelne Funktionen oder die gesamte Plattform vorübergehend nicht verfügbar sein. Sofern möglich, werden Nutzer darüber innerhalb der Plattform informiert. 5. Daten und Dienste Dritter Bestimmte Funktionen der Plattform können auf Herstellerdaten, Datenbanken, Kartendiensten, Wetterdiensten, APIs oder anderen Diensten Dritter basieren. DASP hat keinen Einfluss auf die Richtigkeit, Vollständigkeit oder Verfügbarkeit dieser Informationen und übernimmt keine Haftung für Fehler, Auslassungen oder Ausfälle, die von Drittanbietern verursacht werden. 6.
